It isn’t a myth. If you have been charged with a crime, contact legal counsel immediately. Does this sound straightforward? Absolutely. However, being questioned by law enforcement can be overwhelming and even disorienting. 

For example, some people may continue answering questions because no one ever told them their Miranda Rights. Those only apply during custodial interrogation—or when you are not free to leave. If you are being questioned, outright declare that you wish to speak to an attorney. Don’t hesitate or be ambiguous. Don’t ask if you should have one. Once you have made your intentions clear, the questions cease or at least they should cease.

Being Silent Isn’t Easy

Talking may waive your right to speak with your attorney. Imagine that you have been arrested and detained. As soon as someone asked you a question, you requested an attorney. At that point, you should stop speaking. Understandably, you are anxious, nervous, and are looking for something calming. 

Imagine you ask a police officer about the process, the trouble you face, and the potential consequences. By talking, you may give them the ability to resume interrogating you—although you may not recognize it. They may appear to be making casual conversation with you, but their intentions are focused on the crime. 

You Have A Quick Solution 

Asking for an attorney doesn’t imply you’re guilty. Some people may be, mistakenly, under this impression. With this in mind, you may be eager to explain what happened. Though your intentions are rooted in de-escalating the situation, you may inadvertently incriminate yourself. 

Oftentimes, people think “if I could just explain the situation, then everything would be resolved.”  Even if you have a viable defense, allow an attorney to hear it first. If it is as simple as you think it is, then your attorney will convey your defense to the police and prosecution.. 

The easiest way to remember this is that there is simply nothing you can say to improve the situation. Innocent people can still provide information and facts that could later be used to prove guilt.
