Miami Extradition Attorney

Extradition is the surrendering of one state to another or by one nation to another of an individual accused of a crime in the state or nation demanding the surrender of the accused. A state or nation makes an extradition demand in order to put the accused on trial within its jurisdiction. Extradition may only be sought if the United States has a valid Treaty between the requesting Country. The request by another Country begins the extradition process.

Unlike the legal process by which an individual faces when charged with a crime in the United States, the process for extraditing a person is much different for example, other than determining probable cause, a magistrate does not look to the specific facts of a case to determine guilt or innocence. Additionally, there is a presumption that a person facing extradition in not entitled to bond.
